These Terms and Conditions (“Terms”) govern access to and use of the websites, products, services, subscriptions, payment facilities, and digital solutions offered by Pegazee Solutions.

Pegazee Solutions (“Pegazee”, “we”, “us”, or “our”) is a Sri Lanka-based digital services business owned and operated by Mr. V P A I D S Pathirana.

  • shop.pegazee.com: Our online store for purchasing digital services, managing orders, processing payments, and accessing available subscriptions.

Both websites are operated by the same business and are subject to these Terms.

By placing an order, creating an account, subscribing to a service, or otherwise accepting these Terms, you agree to be bound by them.

If you do not agree, you should not purchase or use our services.

Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited.

3. Eligibility and Customer Responsibilities

Customers must have the legal capacity to enter into a binding agreement or act with appropriate authorization.

By purchasing our services, you confirm that:

  1. The information you provide is accurate and current.

  2. You are authorized to use the payment method selected.

  3. You have the necessary rights to any materials, accounts, or information provided to us.

  4. Your requested services and intended use comply with applicable laws.

  5. You will cooperate reasonably during service delivery.

  6. You will not use our services for fraudulent, deceptive, or unlawful activities.

Customers purchasing services on behalf of an organization confirm that they are authorized to act for that organization.

We may decline a request where there are reasonable legal, security, payment, or operational concerns.

4. Orders and Contract Formation

Customers may place orders through either of our official websites or through an accepted quotation or other authorized sales process.

Submitting an order constitutes an offer to purchase the selected service.

An automated acknowledgment or payment confirmation does not necessarily mean that a custom service order has been accepted.

A contract is formed when we expressly accept the order, confirm that work will commence, or begin providing the requested service.

We reserve the right to decline or cancel an order before acceptance where there is a legitimate reason, including:

  • Incorrect pricing or service information

  • Unavailable services

  • Suspected fraudulent activity

  • Incomplete project requirements

  • Technical limitations

  • Legal or platform compliance concerns

If an order is declined after payment has been captured and no service has been provided, we will arrange an appropriate refund in accordance with applicable law and payment processing requirements.

5. Prices and Supported Currencies

Pegazee Solutions provides services to Sri Lankan and international customers.

Our websites may display prices and process transactions in:

  • USD — United States Dollar

  • LKR — Sri Lankan Rupee

The available transaction currency depends on the checkout configuration, payment gateway, and acquiring bank.

Prices displayed on our websites or quotations apply to the specified service and scope.

Additional work, premium plugins, hosting, domain registrations, third-party subscriptions, licensing, advertising budgets, and other external costs are not included unless expressly stated.

5.1 Currency Conversion

Where a displayed price and the payment processing currency differ, the applicable conversion amount must be presented to the customer before payment authorization.

Currency conversion may be performed using the exchange rate applicable to the checkout or payment provider.

The customer’s card issuer or bank may impose additional conversion charges or international transaction fees.

Such charges are outside our control unless expressly included in our quoted price.

5.2 Taxes

Applicable taxes, where required, will be handled in accordance with relevant tax laws.

Any taxes or additional mandatory charges collected by us will be disclosed as required before checkout completion.

6. Payment Terms

Payments may be accepted through authorized banks, Internet Payment Gateways, card processors, or other supported payment methods.

Customers must provide valid payment authorization and accurate billing information.

Payment methods may vary between pegazee.com and shop.pegazee.com.

We may require full or partial advance payment depending on the service.

For custom projects, payment milestones may be specified in a quotation or separate agreement.

Unless otherwise agreed, work is not required to commence before the applicable initial payment has been received or authorized.

6.1 Payment Processing

Payment transactions may be handled by third-party financial institutions and payment service providers.

Pegazee Solutions does not control all aspects of bank authorization, settlement, currency conversion, or payment processing.

A payment may be declined, delayed, reversed, or held by a payment provider for security, compliance, or technical reasons.

6.2 Failed or Outstanding Payments

If a payment fails or an invoice becomes overdue, we may, after appropriate notice where practicable:

  • Request an alternative payment method.

  • Delay the commencement of services.

  • Pause work on an active project.

  • Suspend access to a subscription service.

  • Withhold undelivered work until the agreed payment is received.

We will exercise these rights reasonably and subject to applicable law and contractual obligations.

7. Digital Service Delivery

Pegazee Solutions primarily provides digital and electronically delivered services.

Depending on the purchased service, delivery may include:

  • Website or web application deployment

  • Electronic files or digital assets

  • Access to software or dashboards

  • Completed technical configurations

  • SEO or marketing work

  • Design files

  • Remote technical services

  • Email delivery

  • Account access or licensing information

  • Project handover documentation

Digital services generally do not involve physical shipping.

Estimated delivery periods are communicated through the relevant service listing, quotation, or written agreement.

Delivery timeframes may depend on project complexity, customer cooperation, third-party approvals, and other relevant circumstances.

Unless expressly guaranteed in writing, estimated delivery dates are not guaranteed completion deadlines.

Where an agreed deadline cannot reasonably be met, we will communicate with the customer and discuss appropriate next steps.

8. Customer Cooperation and Project Requirements

Customers must provide the information and materials reasonably required to deliver purchased services.

This may include:

  • Business information

  • Website content

  • Branding materials

  • Product information

  • Technical requirements

  • Domain or hosting access

  • Authorized account permissions

  • Feedback and approvals

Customers are responsible for ensuring that submitted materials do not infringe third-party rights or violate applicable law.

Project delivery may be delayed where necessary materials, approvals, or instructions are not provided on time.

Any resulting changes to the project schedule will be communicated where practicable.

9. Website Design and Development

Website development services are delivered according to the agreed scope.

The scope may specify:

  • Number of pages

  • Design requirements

  • Website functionality

  • E-commerce features

  • Payment gateway integration

  • Responsive design

  • SEO configuration

  • Content entry

  • Revisions

  • Hosting and domain arrangements

  • Testing and handover requirements

Additional features or changes outside the agreed scope may require a revised quotation or additional payment.

9.1 Revisions

The number and nature of revisions are determined by the applicable service description or written agreement.

Revisions are intended to correct or refine work within the agreed scope.

New features, substantial redesigns, and changes to previously approved requirements may be treated as additional work.

9.2 Project Approval and Handover

Once the agreed deliverables are completed, we may request customer review and approval.

We will address verified defects that fall within the agreed scope and any applicable warranty or correction period.

Project handover may include administrator access, files, documentation, or other agreed deliverables.

Ongoing maintenance is not automatically included after handover unless expressly agreed.

10. Search Engine Optimization Services

SEO services may include:

  • Keyword research

  • On-page optimization

  • Technical SEO

  • Website performance recommendations

  • Search engine indexing support

  • Metadata optimization

  • Content optimization

  • SEO audits

  • Reporting and consultation

Search engine rankings are determined by independent search engines and may be affected by algorithm changes, competition, website quality, and other factors.

Pegazee Solutions does not guarantee first-page rankings, specific keyword positions, traffic volumes, or sales results unless a particular measurable deliverable is expressly agreed in writing.

We undertake to provide the purchased SEO services with reasonable care and professional diligence.

11. Social Media and Digital Marketing

Digital marketing services may include content planning, social media management, advertising configuration, graphic design, campaign management, and reporting.

Customers remain responsible for ensuring that their products, advertisements, and business claims comply with applicable laws and platform policies.

Advertising budgets and third-party platform charges are separate from our service fees unless expressly included.

Marketing results depend on factors outside our control, including audience behavior, platform algorithms, market competition, and advertising budgets.

We do not guarantee particular sales, followers, impressions, conversions, or revenue unless expressly agreed in writing.

12. Fiverr and Third-Party Marketplace Services

Pegazee Solutions may provide freelance marketplace support services, including profile guidance, gig optimization, account assistance, order management support, and related consulting.

All such services must comply with the applicable marketplace’s terms and policies.

We do not guarantee:

  • Marketplace account approval

  • Specific search rankings

  • Seller levels or badges

  • Buyer orders

  • Revenue or earnings

  • Account reinstatement

  • Platform algorithm outcomes

We do not authorize fabricated reviews, sham transactions, deceptive ratings, impersonation, or other activities prohibited by the relevant platform.

Any review-related service must be based on genuine, eligible customer experiences and comply with the applicable platform rules.

Pegazee Solutions is an independent service provider and is not officially affiliated with Fiverr or any other third-party marketplace unless expressly stated and authorized.

13. Custom Web Applications and POS Solutions

Custom web applications, POS systems, integrations, and software solutions are delivered according to the agreed specifications.

Project agreements may define:

  • Features and modules

  • User roles and permissions

  • Software integrations

  • Hardware compatibility

  • Data migration

  • Testing requirements

  • Hosting arrangements

  • Licensing

  • Training

  • Maintenance and support

  • Deployment procedures

Third-party hardware, software, APIs, and services may require additional fees or licenses.

Customers are responsible for ensuring that their use of software complies with applicable business, tax, employment, data protection, and other legal requirements.

We will use reasonable care in performing agreed development and implementation services.

14. Subscriptions and Recurring Services

Pegazee Solutions may offer monthly, annual, or other recurring plans.

Subscription services may include:

  • Website maintenance

  • SEO management

  • Social media management

  • Software access

  • POS solutions

  • Technical support

  • Security monitoring

  • Website updates

  • Other recurring digital services

14.1 Subscription Activation

A subscription becomes active according to the plan terms and confirmation provided at purchase.

The selected plan determines the services, limits, billing interval, and applicable charges.

14.2 Automatic Renewals

Where automatic renewal is offered, the recurring amount, billing frequency, and renewal conditions will be disclosed before purchase.

By expressly authorizing automatic renewal, the customer authorizes the payment provider to process recurring charges according to the selected plan until the subscription is canceled or otherwise terminated.

Plans without automatic renewal require manual payment for continuation.

14.3 Subscription Cancellation

Customers may request cancellation by contacting:

hi@pegazee.com

Where an account-based cancellation feature is available, customers may also use that feature.

Cancellation requests should be submitted before the next renewal payment is processed.

Unless otherwise stated in the applicable plan or required by law, cancellation prevents future renewal charges but does not automatically refund the current billing period.

Cancellation does not remove any mandatory rights to refunds or remedies.

14.4 Subscription Changes

Plan upgrades, downgrades, and changes may affect pricing, features, service limits, or billing dates.

Any applicable additional charge will be disclosed before the customer authorizes the change.

14.5 Non-Payment

If a recurring payment fails, we may notify the customer and provide an opportunity to update the payment method.

Continued non-payment may result in suspension or termination of the affected subscription, subject to applicable law and plan terms.

15. Refund and Cancellation Policy

Pegazee Solutions primarily provides digital services, customized professional work, software-related services, and subscription-based solutions.

Because these services may involve immediate work, resource allocation, customization, and electronic delivery, payments for services already commenced, performed, delivered, or made available are generally non-refundable, except where a refund or other remedy is required by applicable law or the agreed contract.

Refund requests may be considered individually in circumstances including:

  • Duplicate payments

  • Incorrect billing

  • Non-delivery of a purchased service

  • Verified material failure to provide the agreed service

  • Other exceptional circumstances

For work that has not commenced, cancellation and refund eligibility will depend on the agreed terms, any reasonable costs already incurred, and applicable law.

For partially completed projects, any refund assessment may take into account the value of work already performed and any non-recoverable third-party costs, to the extent permitted by law.

We do not guarantee approval of discretionary refund requests.

Refunds that are legally required will not be withheld solely because the purchased service is digital.

Approved refunds will ordinarily be processed through the original payment method where supported by the payment provider.

Refund processing times may depend on the acquiring bank, card issuer, and payment service provider.

For refund requests, contact hi@pegazee.com with your order number, payment reference, and explanation.

Our separate Refund and Cancellation Policy provides additional details and forms part of these Terms.

16. Chargebacks and Payment Disputes

Customers are encouraged to contact us promptly if they believe a payment is incorrect, duplicated, unauthorized, or associated with a service delivery problem.

We will review legitimate concerns and cooperate with applicable payment dispute procedures.

Where a chargeback or payment investigation occurs, we may provide relevant invoices, service records, customer communications, and delivery evidence to the authorized payment provider or financial institution.

We will not restrict customers from exercising lawful payment dispute rights.

Fraudulent payment activity or deliberate misuse of our services may result in appropriate account restrictions or legal action, subject to applicable law.

17. Intellectual Property Rights

Unless otherwise agreed in writing, Pegazee Solutions retains ownership of its pre-existing intellectual property, including:

  • Proprietary software

  • Development frameworks

  • Reusable code libraries

  • Internal tools

  • Business methods

  • Templates

  • Documentation

  • Brand materials

  • Other pre-existing resources

Ownership of custom project deliverables will be determined by the applicable service agreement.

Where the agreement provides for transfer of specified deliverables, such transfer will occur according to the agreed conditions, including any applicable payment requirements.

Third-party software, plugins, fonts, themes, APIs, and licensed materials remain subject to their respective owners’ license terms.

Customers retain rights to materials they lawfully own and provide for project use.

We do not claim ownership of customer-provided content merely because it is used in delivering our services.

18. Third-Party Services and Integrations

Our services may involve third-party providers such as:

  • Domain registrars

  • Hosting companies

  • Payment gateways

  • Cloud providers

  • Advertising platforms

  • Search engines

  • Software vendors

  • Social media platforms

  • Freelance marketplaces

  • API providers

Third-party services may have independent terms, fees, availability conditions, and privacy policies.

Pegazee Solutions is not responsible for independent third-party actions or outages outside our reasonable control.

However, we remain responsible for our own agreed work and any obligations that cannot legally be excluded.

19. Customer Accounts and Security

Customers are responsible for maintaining reasonable security of their accounts and credentials.

You agree to:

  • Provide accurate account information.

  • Protect your login credentials.

  • Avoid sharing unauthorized access.

  • Notify us of suspected account misuse.

  • Use our services lawfully.

We may restrict or suspend an account where reasonably necessary to address suspected fraud, security threats, unlawful conduct, or material breaches of these Terms.

Where practicable, we will provide appropriate notice and an opportunity to resolve the issue.

20. Website Maintenance and Technical Support

Maintenance and support services are provided according to the selected plan or separate agreement.

Such services may include website updates, security monitoring, backups, performance optimization, troubleshooting, and agreed content changes.

Maintenance does not guarantee that a website will never experience downtime, security incidents, compatibility issues, or third-party service failures.

The specific scope, frequency, support availability, and service limits are determined by the applicable plan.

Requests beyond the agreed scope may require additional fees.

21. Confidentiality and Data Protection

We recognize that customer projects may involve confidential business information, credentials, and personal data.

We will handle such information in accordance with applicable confidentiality obligations, service agreements, and our Privacy Policy.

Customers must have appropriate authorization to provide information or system access to us.

Our Privacy Policy applies to personal information processed through both websites.

Privacy Policy:

22. Prohibited Activities

Customers must not use our websites or services to:

  • Commit fraud or financial crimes.

  • Violate applicable laws.

  • Distribute malware or harmful software.

  • Infringe intellectual property rights.

  • Conduct unauthorized access or hacking.

  • Submit false or stolen payment information.

  • Engage in deceptive marketplace manipulation.

  • Publish fabricated customer feedback.

  • Misuse third-party accounts or services.

  • Harass, threaten, or unlawfully discriminate against others.

  • Engage in activities that materially compromise the security or integrity of our systems.

We may decline or discontinue services involving prohibited conduct, subject to applicable contractual and legal obligations.

23. Service Availability and Changes

We aim to maintain reliable websites and services.

However, access may occasionally be affected by:

  • Scheduled maintenance

  • Software updates

  • Hosting outages

  • Network interruptions

  • Security incidents

  • Third-party service failures

  • Circumstances beyond our reasonable control

We may modify website features or service offerings where reasonably necessary.

Material changes affecting an active paid service will be handled according to the applicable agreement and legal requirements.

24. Warranties and Service Standards

Pegazee Solutions undertakes to perform its professional services with reasonable care and skill.

Specific warranties, correction periods, and service commitments may be established in the relevant quotation or written agreement.

Except for express contractual warranties and warranties or guarantees that cannot legally be excluded, we do not promise uninterrupted operation, error-free third-party systems, or particular commercial outcomes.

Nothing in these Terms limits statutory consumer guarantees or mandatory legal remedies.

25. Limitation of Liability

To the extent permitted by applicable law, Pegazee Solutions will not be liable for indirect or consequential losses, such as lost business opportunities or anticipated profits, arising from circumstances outside our reasonable control.

For claims arising under a particular service agreement, our aggregate contractual liability will, to the extent legally permitted, be limited to the fees paid or payable for the specific service giving rise to the claim.

This limitation does not apply where prohibited by law, including liability that cannot lawfully be limited for fraud, willful misconduct, or other legally protected claims.

Nothing in these Terms removes any mandatory rights or remedies available to customers.

26. Customer Indemnification

To the extent permitted by law, customers agree to indemnify Pegazee Solutions against reasonable third-party claims, losses, and expenses arising directly from:

  • Materials supplied without necessary rights or permissions

  • Unlawful instructions or customer-directed activities

  • Fraudulent or unauthorized use of our services

  • Material breaches of these Terms

This provision does not apply to losses caused by our own negligence, misconduct, or breach of legal obligations to the extent that responsibility cannot lawfully be transferred.

27. Force Majeure

Neither party will be responsible for delays caused by extraordinary events beyond its reasonable control, including natural disasters, major network failures, government restrictions, widespread infrastructure interruptions, or similar events.

The affected party must take reasonable steps to reduce disruption and resume performance.

If such circumstances materially prevent service delivery for an extended period, the parties may discuss an appropriate adjustment, termination, or remedy consistent with applicable law.

28. Complaints and Dispute Resolution

Customers may submit complaints regarding services, billing, subscriptions, or project delivery by contacting:

hi@pegazee.com

Please include relevant order details and a description of the concern.

We will make reasonable efforts to investigate and resolve complaints fairly.

Where a dispute cannot be resolved informally, either party may pursue available legal or regulatory remedies.

Customers retain any mandatory rights to payment disputes, consumer protection remedies, or other lawful complaint procedures.

29. Governing Law and Jurisdiction

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, except where mandatory laws applicable to a customer require otherwise.

Subject to applicable consumer protection rules and other mandatory jurisdictional requirements, disputes arising from these Terms may be brought before the competent courts of Sri Lanka.

This provision does not deprive customers of protections or remedies that cannot lawfully be excluded.

30. Electronic Communications

By communicating with Pegazee Solutions electronically, you acknowledge that service communications, invoices, order confirmations, and other business records may be provided electronically.

Electronic agreements and communications will be handled in accordance with applicable laws, including Sri Lanka’s Electronic Transactions Act No. 19 of 2006, as amended.

Where legally permitted, electronic acceptance may form part of a binding agreement.

31. Amendments to These Terms

We may update these Terms to reflect changes in business operations, technology, payment processing, services, or applicable law.

Updated Terms will be published on our official websites with a revised date.

Material changes affecting existing paid agreements will be handled in accordance with those agreements and applicable law.

Unless otherwise lawfully agreed, updated Terms will not retroactively remove rights already accrued under an existing contract.

32. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

33. Entire Agreement and Order of Precedence

These Terms, together with the applicable service description, accepted quotation, statement of work, subscription conditions, and referenced policies, form the agreement governing the purchased service.

Where a separately signed or expressly accepted project agreement conflicts with these general Terms, the more specific agreement will prevail for that project, except where prohibited by law.
